"You could have a voter acting really diligently, filling out their mail ballot, putting their ballot in the mail a week before the election, and given the cuts and the inefficiencies the United States Postal Service, that might not be delivered till eight to ten days after they put it in the mailbox. And that's not the election officials' fault. That's something that's on the Postal Service. What this means is that regardless of what the decision is, it's not for the White House, it's not for the Supreme Court, to decide who makes that decision. The state legislatures get to make that decision. That's the right call with regard to election policy. As we've discussed before, the Constitution enshrines that power in state legislatures. The Elections Clause, the Constitution, Article 1, Section 4, also gives Congress some power, but Congress has not acted on this."
