"You're saying be very cautious about what you wish for in terms of changing the bail laws. Be careful about who you put in prison who hasn't been convicted. Yeah, well, I think it's important to acknowledge that we have a presumption and a right to bail in Ireland and start from that point. And if somebody is not a good candidate for bail, instead of putting them straight in prison, are there other alternatives? And there are alternatives that are available to courts, but when it comes to somebody who's homeless, when it comes to somebody who's in need of serious psychiatric treatment, judges are limited in terms of what they can do. You know there will be people watching tonight, Niamh. You'll say, yeah, that's all very well. That's nice and liberal, but we need to put people behind bars where they belong. What would you say to that? I would draw their attention to the case of Mr. Ivan Rosny and his death and custody report was published only a couple of months ago who was arrested outside of his home while having an acute psychotic episode. He was brought by the guardee to the hospital where he was refused admission. He ended up going into remand custody and died in remand custody in active psychosis while being restrained without the treatment that he needed in a completely inappropriate environment. And those are the kind of cases that IPRT are seeing, and that's what we're seeing in the remand system."
