This represents a massive shift for Principle 6, the separation of powers. While proponents argue it restores direct accountability to the elected executive, it actively challenges Principle 4, the rule of law. For nearly a century, these independent boards were insulated from partisan winds to protect businesses and workers from volatile policy swings. Now federal, labor, consumer, and financial rules will change overnight with every presidential election, replacing objective law with political compliance. Issue 2. The Guardrail's Hold On Citizenship But while the court expanded executive power over agencies, it drew an iron-clad line of sand on individual rights. In Trump v. Barbara, the justices ruled against an executive order that attempted to unilaterally end birthright citizenship for children born on American soil to undocumented parents.
